LEOSA Liability Coverage for Active Federal Law Enforcement Officers

FEDS Protection developed the LEOSA Endorsement for active federal law enforcement officers to fill the exposure gaps of federal LEOs carrying off-duty.

This optional protection, which can be added to the FEDS Federal Employee PLI policy, provides civil liability and criminal investigation coverage for legal and justified acts of qualified federal LEOs under the Law Enforcement Officer Safety Act of 2004 and the LEOSA Improvement Act of 2010.

While these Acts allow qualified LEOs to act off duty, they do not shield from civil and criminal liability exposure.

Active federal LEOs can add this endorsement to your coverage at the time you apply for or renew your FEDS PLI policy.

Even if you are authorized to carry off-duty, representation from your agency in the event of a LEOSA incident is not automatic or mandatory. Your agency may decide that you were acting outside of scope, outside of the interest of the U.S. to defend, and/or outside of agency LEOSA authority for off-duty incidents. The FEDS Protection LEOSA Endorsement for Active Federal LEOs safeguards officers by providing the following coverage:

  • Civil liability for bodily injury or property damage caused by a lawful act under LEOSA, an act of self-defense, or the defense of a spouse/legal dependent.
  • Criminal defense resulting from an alleged criminal action involving self-defense, or the defense of a spouse/legal dependent.
  • Criminal defense against state charges of unlawful carriage of a firearm or federally legal ammunition when lawfully carrying under LEOSA.

$250,000 LEOSA Endorsement

  • Additional $100 annually (plus Surplus Lines Tax)
  • $250,000 in coverage for legal defense and indemnity related to civil lawsuits for bodily injury or property damage caused by a lawful act under LEOSA, an act of self-defense, or the defense of a spouse/legal dependent.
  • $50,000 in coverage for criminal defense resulting from an alleged criminal action involving self-defense, or the defense of a spouse/legal dependent.
  • $25,000 in coverage for criminal defense against state charges of unlawful carriage of a firearm or federally legal ammunition when lawfully carrying under LEOSA.

$500,000 LEOSA Endorsement

  • Additional $150 annually (plus Surplus Lines Tax)
  • $500,000 in coverage for legal defense and indemnity related to civil lawsuits for bodily injury or property damage caused by a lawful act under LEOSA, an act of self-defense, or the defense of a spouse/legal dependent.
  • $50,000 in coverage for criminal defense resulting from an alleged criminal action involving self-defense, or the defense of a spouse/legal dependent.
  • $25,000 in coverage for criminal defense against state charges of unlawful carriage of a firearm or federally legal ammunition when lawfully carrying under LEOSA.
