Insurance Coverage

The following is a brief overview of the coverage provided by the
FEDS Professional Liability policy:

  • FEDS PLI pays up to $1,000,000 or $2,000,000 (depending on the policy limit you choose) of professional liability damages to federal employees who are sued for any act, error or omission which are committed or arise out of the course and scope of employment. Moreover, in the event that the Department of Justice exercises its discretion to deny representation, this provision also provides the legal representation necessary to defend.  Note: this defense amount is separate and distinct and not subject to the defense limits of the administrative and criminal provisions.  More information is available regarding civil suit, personal suit, Bivens' Action exposure and policy coverage in About Your Exposures under your position or agency.  For general examples, see Civil Scenarios.

  • FEDS PLI pays for legal defense up to $200,000 for any administrative investigation into alleged misconduct or disciplinary or judicial sanction proceeding from any act, error, or omission committed by a federal employee while rendering a professional service.  For examples of allegations leading to investigations - such as management, OIG, OPR, RMO, Internal Affairs, Congressional, etc. as well as disciplinary actions, please visit your position or agency in About Your Exposures.  For general examples, see Administrative/Disciplinary Scenarios.

  • FEDS PLI pays for legal defense up to $100,000 for any criminal investigation or proceeding into any act, error, or omission committed by a federal employee while rendering a professional service.  The FEDS policy will NOT seek to recover defense fees from the Insured if a finding of guilt occurs.  This is referred to as a 'claw back' provision in similar professional liability policies for federal employees. In addition to these core liability protections, the FEDS policy provides the following free benefit, which other policies charge extra for:

  • Two free ½ hour legal consultations for pre complaint matters, matters that are not covered or otherwise excluded by the policy.  With lawyers charging $250 to $350 per hour, this benefit alone is worth having a FEDS PLI policy.  See Consultation Scenarios.

 Other Distinctive Policy Features:

  • FEDS PLI covers federal employees who are serving in international posts of duties.  This is especially important for State, USAID, intelligence, law enforcement and other federal employees serving abroad. 
     
  • No deductibles.

  • Standard policy exclusions such as Nuclear, Vehicle, Environmental, Pollution and/or violations of Security laws do not apply when it is within the scope of the insured member's employment to work on or within the excluded subject matter area.  

  • FEDS PLI provides a 36 month extended reporting period after you retire or otherwise leave federal service - at no additional charge.

  • FEDS PLI provides pro rata refunds for members who retire or otherwise leave federal service.  Similar professional liability policies for federal employees contain a 'non-refundable' provision.

  • FEDS liability benefits are secured by a U.S. based insurance company with an AM Best Financial Strength rating of (A) (Excellent). Financial strength information available here.
